• Before concluding the purchase contract, the CUSTOMER reads the characteristics of the goods that are illustrated in the individual PRODUCT sheets at the time of choice by the CUSTOMER. Before the conclusion of the purchase contract and before the validation of the order with “obligation to pay“, the CUSTOMER is informed about:
  • identity and seat of the professional;
  • total price of the goods including taxes, with details of shipping costs and any other costs;
  • payment methods;
  • the deadline within which Artevivente.it undertakes to deliver the goods;
  • conditions, terms and procedures for exercising the right of withdrawal;
  • information that the CUSTOMER will have to bear the cost of returning the goods in the event of withdrawal;
  • existence of the legal guarantee of conformity only for non-perishable goods purchased;
  • absence of the legal guarantee of conformity for perishable goods purchased;

Conclusion of the Sales Contract

• These general terms and conditions of sale are an integral and essential part of the contract of sale with the customer. The electronic submission of the order by the customer implies total knowledge of these General Terms and Conditions of Sale and their full acceptance. If the customer does not agree with one or more of the terms contained in these General Terms and Conditions of Sale, he or she is requested to refrain from making purchases on CelaOrchidee.it (the “Site”).
• To proceed with the purchase of one or more products on the Site, the customer must first register on the Site, providing Artevivente.it, in compliance with the applicable provisions on the protection of personal data, with all the data necessary to allow the latter to execute the orders submitted.
• To conclude their purchase contract with Artevivente.it, the customer must send their order to Artevivente.it by following the procedure set out on the Site. The electronic submission of the order gives rise to the obligation on the part of the customer to pay the price indicated therein.
• When the customer places an order, he will receive an email from Artevivente.it containing the confirmation of receipt of the order and a summary of the same: however, this email will not constitute automatic acceptance of the order itself.
• Artevivente.it reserves the right to refuse orders from clients with whom there is an ongoing dispute regarding the payment of a previous order.
• If you request an electronic invoice, please request it at the same time as the order, it is made with a minimum taxable amount of € 200.00.

Sales Prices

• All the sale prices of the products displayed and indicated on the Site are EXCLUDING VAT, the latter will be calculated during checkout.
• The cost of shipping and transport, if any, will be clearly indicated and displayed before the order is placed.
• Product prices may be subject to updates. The customer is obliged to ascertain the final sale price before placing the relevant order.

Shipments

• Artevivente.it will do its best to process the orders transmitted within 10 working days and in any case no later than 30 days from the day following the day on which the customer sent the order, normally shipments that will be received by Saturday will be processed only on the shipping days of Monday or Tuesday, to ensure that the plants remain in the hands of the shipper for as little time as possible and avoid weather and warehouse problems during the the weekend.
• Artevivente.it reserves the right, in the event of periods of extreme heat or cold, not to make shipments. In this case, the shipping date will be agreed with the customer or the order will be shipped at the customer’s risk.

Shipping Methods

The choice of the shipping method is up to you, directly selecting the various possible options during the confirmation and payment of the order.

STANDARD shipments are not insured, in case of loss of the package, or damage to the contents of the same during transport by the courier, it will not be possible to make refunds or resend of the goods.

It will be possible to select the INSURED shipment to have shipping insurance coverage and total refund (up to 300 euros) in case of loss or damage to the package by the courier (excluding damage to stems or flowers). The INSURANCE will be stipulated directly with the shipping company and the latter will make refunds in the cases mentioned above.

The delivery address must be clearly and correctly indicated. The costs for sending back to the recipient shipments returned to the sender due to incorrect or missing delivery data provided at the time of the order are borne by the customer (including any storage and redelivery costs).

In the event of failure to collect the shipment by the customer (non-presence of the recipient or delegate) the package will be kept in storage at no additional cost for 7 days during which further delivery attempts will be made or, alternatively, a special receipt will be issued for collection of the same at the courier’s depot or the local post office. After this period, the shipment will be sent back to the sender and payment of storage and redelivery costs will be required for this.

In winter we give the possibility to add a heating package inside the package, for only € 2 more, so as to protect the plants from the cold during the journey. No complaints will be accepted for plants damaged by the cold from those who do not take advantage of this option.

Risks and Transport

Goods always travel at the Buyer’s own risk. The Seller is not liable for damage suffered by the goods during transport, as the same must be reported to the carrier, in writing, within the established terms. The goods are entrusted to the carrier chosen by the customer. In the absence of clear and unequivocal provisions in this regard, the Seller will entrust the goods to carriers deemed suitable by the same, without any liability.

Payments

• For the payment of the price of the products and the related shipping and delivery costs, if any, the customer can follow one of the methods indicated in the order form. Under no circumstances will additional costs be charged in relation to the payment instrument chosen by the customer.
• The customer is solely responsible for the data entered, therefore he guarantees to use only credit cards of which he has the legitimate availability.
• The customer can proceed with the payment by bank transfer. The instructions will be communicated to the customer at the time of payment.

Responsibility

• Artevivente.it assumes no responsibility for inefficiencies attributable to force majeure such as, by way of example, accidents, explosions, fires, strikes and/or lockouts, earthquakes, floods and other similar events that prevent, in whole or in part, the execution of the contract within the agreed timeframe.
• Artevivente.it shall not be liable to any party or third party for damages, losses and costs incurred as a result of non-performance of the contract for the causes mentioned above, as the customer shall only be entitled to a refund of the price paid.
• Artevivente.it is not responsible for any fraudulent or illicit use that may be made by third parties of credit cards, cheques and other means of payment, at the time of payment for the products purchased. Artevivente.it in fact, at no time during the purchase procedure is it able to know the customer’s credit card number which, by opening a protected connection, is transmitted directly to the bank service provider.
• The gift cards that can be purchased on our site are valid for 1 year within which the amount can be spent, after which the validity will expire and the amount will no longer be usable.
• The essential characteristics of the products are presented on the Site within each product sheet.
• The photographs on our website are purely indicative. Some photos in the “SHOP” section come from other websites: if anyone recognizes your photo and does not like to see it on this site, please let us know. We will remove it.

Flowering Plants

• Arteviventye.it reserves the right not to ship flowering plants or plants with buds because these are easily damaged during transport, despite our careful packaging. For any requests for flowering plants or if plants in this condition are shipped by purchasing them from the FLOWERY section of the site, Artevivente.it is not responsible for the integrity of the flowers and buds at the time of delivery. Complaints and return requests are not accepted in this case.

Obligations of the customer

• The data entered during the purchase phase must be exclusively your real personal data and not those of third parties, or fictional. Artevivente.it reserves the right to prosecute any violation and abuse, in the interest and for the protection of all consumers.
• The customer Artevivente.it indemnifies from any liability deriving from the issuance of incorrect tax documents due to errors relating to the data provided by the customer, being himself solely responsible for the correct entry.

Shipping, Complaints, Returns, and Refunds

Complaints

• At the time of delivery of the goods, the customer must check the integrity of the packages and the quantitative and qualitative correspondence with what is indicated in the order confirmation. Even if the packaging is intact, the goods must be checked within 24 hours of receipt. Any case of quantitative or qualitative discrepancies must be reported by telephone or computer as soon as possible within 7 days of delivery. Any report after the aforementioned terms will not be taken into consideration. For each declaration, the customer assumes full responsibility for what is declared.

Made

• Artevivente.it reserves the right to replace the product only if it does not comply with what the customer ordered. Although we strive to provide the correct taxonomic identification, in the event of errors on the website, we are available, subject to written agreement between the parties, to replace the plant in question within 30 days from the time of receipt of the product by the customer.
• Due to the delicate nature of the product, it is not possible to return plants that comply with the customer’s order.
• Plants always travel at the risk and peril of the client. On our part, there is always the utmost commitment to choose the most reliable shippers and to take care of the packaging of the purchased product.
• The customer may instead submit the return request for all materials on the Site within fourteen (14) days of receipt of the products. The products must be returned intact, with the packaging closed when present, unwashed, undamaged and provided with tags, labels and any other seal that is part of the products; Products that are returned incomplete, ruined, damaged, deteriorated or soiled will not be refunded.
• The products you intend to return must be delivered to the shipper within fourteen (14) days, starting from when you have notified Artevivente.it of your decision to withdraw from the contract.
• The costs of returning the materials will be borne by the Customer, including liability in the event of loss or damage to the products.
• After the return of the products, the Vendor shall carry out the necessary checks relating to their compliance with the conditions and terms indicated in this paragraph.

Refunds

• If the right of withdrawal is exercised in accordance with the terms and conditions set out in this paragraph, Artevivente.it will refund the customer any sums already collected for the purchase of the products, with the exception of shipping costs.
• Whatever the payment method used by the customer, the refund is activated by the Seller as soon as possible and in any case within fourteen (14) days from the date on which the Seller became aware of the exercise of the right of withdrawal, subject to verification of the correct execution of the same and verification of the returned products.
• The Vendor will make the refund using a voucher or gift voucher.
• If the payment was made in installments, we will have to wait for the arrival of the last installment before being able to make the refund.

Size and Dimension

• Given the nature of the products on sale, the dimensions will vary from a few centimeters to over a meter, depending on the variety and/or species. “Plants with N years to flowering” are young plants that will take about N years to flower. “Strength flower plants” are young plants or divisions of adult plants, which have already made a first flowering or have in any case reached the size of a plant capable of flowering within the year. “Adult plants” are good-sized plants that have already flowered several times.
• Their ability to flourish over time, however, is not attributable to Artevivente.it, but only to the correct care carried out by the customer.
• Pot sizes, substrates, and media may vary depending on availability.

Applicable law and jurisdiction

• Any dispute relating to the application, execution, interpretation and violation of purchase contracts stipulated through the Artevivente.it website is subject to Italian law; These general conditions refer, for anything not expressly provided for therein, to the rules provided for by the Civil Code, as well as to Legislative Decree no. 205/06 (“Consumer Code”).
• Any dispute between the parties regarding this contract will be subject to the exclusive jurisdiction of the Court of Trapani.
